Sidewalk sheds, also known as scaffolding, are a common sight in New York City. These structures are typically erected to protect pedestrians from falling debris or to provide support for building renovations. While they serve an important safety function, they can also be a nuisance in neighborhood if left up for years on end. There currently are ${d3.format(",")( sheds.length )} active sheds. The average age of a shed is ${d3.format( 0.3 )( d3.mean(sheds, (d) => d.Age) )} days old, and the oldest shed is ${d3.format( 0.3 )(sheds[sheds.length - 1].Age / 365)} years old. There are two main reasons why sheds might be up, building construction or maintenance, or due to unsafe facades (Local Law 11). Of the ${ sheds.length } sheds, ${sheds_locallaw.length} or ${d3.format(".2%")( sheds_locallaw.length / sheds.length )} are required by Local Law 11 inspections. The other ${d3.format(".2%")( (sheds.length - sheds_locallaw.length) / sheds.length )} percentage are made up by Construction or Maintenance. ## What is Local Law 11? Local Law 11 also known as the **[Façade Inspection Safety Program](https://www.nyc.gov/site/buildings/safety/facade-inspection-safety-program-fisp-filing-instructions.page) (FISP)**, requires the owners of certain buildings to conduct regular inspections of the exterior walls and appurtenances of their buildings and to file reports of their findings with the Department of Buildings (DOB). The law applies to buildings **over six stories** in height, and inspections must be done **every five years** by a licensed architect or engineer. The purpose of the law is to ensure the safety of the public and the preservation of the structural integrity of buildings. ${note`Buildings that have six stories and a basement (above 50% of the grade; as apposed to a cellar) must be inspected as well.`} > Buildings that are inspected and graded **Unsafe** or buildings that have two consecutive inspection cycles graded **Safe With a Repair and Maintenance (SWARMP)** must have sidewalk sheds up. `; }32:Tb7d,sn` ## Cycles To avoid having all buildings inspected at the same time, the DOB has inspections sub-cycles. We are currently in Cycle 9, which runs from February 21, 2015, through February 20, 2025. Cycle 9 is broken down into sub-cycles A through C, tax blocks that end with specific lot numbers must file between the dates of their sub-cycle. ${note`Cycle 9 sets forth new requirements. Some highlights are at least one physical examination per 60 linear feet of the facade along a Public Right of Way; date photo documentation with the QEWI in the photo; and a cavity wall probe (the wall behind the Façade) every odd cycle. Others rules note the use of drones, high-resolution photography, non-destructive testing, or other similar methods does not eliminate the requirements for close-up inspections. ## Inspections in detail An inspection will end with a grade of : - Safe: No problems and in good condition (OK) - Safe With a Repair and Maintenance Program (SWARMP) - Unsafe: Problems/defects threaten public safety (UN) **OK** graded buildings don't need to be inspected until the next Cycle. **SWARMP** are buildings that have at least one condition that is not a hazard at the time and does not need to be repaired in 12 months. SWARMP does not need immediate action but it is necessary to complete repairs by the start of the next cycle. If repairs are not made the condition of the façade must be classified as Unsafe. A facade may not be classified as “SWARMP” for two consecutive filing cycles. **UN** is a building with at least one condition that is an immediate hazard or needs to be fixed within 12 months. It would be reported to the DOB and with a sidewalk shed installed. Repairs are permitted for 90 days. If the repairs take longer than 90 days, the DOB can grant extensions if certain conditions are met. A timeframe needs to be established to complete repair work with a completion date (MM/DD/YY). Timeframes of more than five years will not be accepted. These timeframes are taken to account when there is there are extensions. To resolve an UNSAFE grade, an amended report must be filed and DOB must accept it. New rules under the Rules of the City of New York §103-04

- Buildings that don't repair SWARMP conditions for two cycles, which roll overs to UNSAFE would get a fine of $2,000 - An extension request would cost $305 to file.
